I am not sure where to post this question but since this board is so active I thought I would begin here. Does anyone know?
I went to my bank about 2 weeks ago to inquire about a merchant acct. I signed the what seemed like 1400 pgs.contract - the woman that I was dealing with said she would call me when the machine came in and we would discuss the operations. She handed me a packet of info. and I ASSUMED that my contract was in there...nope.
Inbetween today and two weeks ago I had decided that I was not going to need the machine or the services of the merchant acct. Went to look for my contract and did not find it (wondering what my options were if I cancelled). Also, there was no mention of a cancellation policy during our talk.
She calls me today to let me know the machine is in - I tell her that I have changed my mind and will not be needing it due to unforseen circumstances. She says there is a 50.00 restocking fee. Hmmmm....I said, you did not mention it to me during our talk - she said it is in the contract - I said, you did not give me a copy of my contract - she said she was waiting to give it to me when we spoke. She said she would make a call and call me back. Has now lowered the stocking fee to 25.00.
My point is....I feel that she should have mentioned it to me that if I decide to cancell this is what I am looking at and she should have given me a copy of my contract. I was in leasing for a couple of years and I made sure people knew up front what they were dealing with - nothing was hidden and I gave them a copy of their contract to take with them.
My question is......does anyone think there is a way if I call her mgr. ( I did get her name and number) that I can get out of the stocking fee?

Yeah you can always try. Why not? I notice that these kind of issues with contract can be a bit sloppy so that people like this woman's ass will be covered even if you didn't make you fully aware of the terms and condtions before you signed. Like I guess she could say that she told you the necessary info and then the rest was up to you to figure out before you signed. Also they will give you an enormous "book"like contract so as to put you off even more from informing yourself of what you're agreeing to when you sign under the dotted line.

Oh...I'll try alright! I'm an Aries - we don't give up easily especially if we feel we have been done wrong to - Justice fighters we are!
Thanks MD - while we were talking she did admit that she does not tell people about this cancellation fee - I said you may want to share this info. as it is an important part of the contract and what one needs to know should this arise. She said, "yes, I suppose you are right."

Right...well maybe she just forgot. Give it a go anyway. She sounds honest enough if she admitted that she had forgotten to tell you about the cancellation fee.
