The past century forced america to call into the validity of the document that governs us. If all men are equal, what does that mean for women? If all men are equal, what of the 3/5ths compromise?
I think we're in an age where the government is having to walk the fine line of actually upholding our laws. What's right? The law or the collective conscious?
In the same vein, is it ok to protest outside of soldiers funerals? Legally, yes. Morally, no. So the question is, can you morality and to what extent?

Q, I get your point but the question is both moral and legal. Yes, freedom of religion but we also have laws that prohibit inciteful speech/acts. One could argue that the presence of a mosque in close vicinity to the WTC sites could be inciting.
If you can predict violence before an act occurs, you restrict the act. Its the "yelling fire in a crowded theatre" argument. Can we not assume that damage will occur to this mosque and the people that worship there? And is the potential violence enough to lawfully deny the act?
Segregationists used the same rationale to deny black students entry into white schools. So I'm with you, legally wrong but morally, what is the Imam trying to prove?

On top of that, the "sacred" regard to which we hold places/monuments evolves overtime. The vatican retains its importance to catholics and to my knowledge, there isn't a mcdonalds adjacent to stone henge.
If the WTC site is regarded as an area sensitivity why shouldn't that be respected?
