Sunday night (12/3) I went to a bar back home with a friend of mine.
We went early to see one of our friends who happens to bartend there. Since we know her outside of the bar she typically passes us a few free drinks.
She ended up switching shifts and working til close, so we stayed later than I initially expected. I kept drinking, I was having a great time, so was my friend.
Then, I wanted to go back and sleep off my drunkeness before I had to drive 150 miles back to my current residence. My friend didn't want to leave yet, so I got a cab to take me back to my friend's house.
The cab driver dropped me off at the wrong house. I was very much so intoxicated, and ended up knocking on the door anyways (stupid). The lady in the house was frightened and called the police on me.
The officers offered to take me to my dad's house... I couldn't go there in the condition I was in, so in my very intoxicated stupor, I chose jail instead. I spent the night in the detox cell and I was charged with Disorderly Conduct (Public Intoxication), a 4th degree misdemeanor.
I was released on O.R. monday morning at 7am, got a cab to take me to my friend's place where my car was, I stayed for a bit, then drove back home.
Monday afternoon, before heading to work, my car wouldn't start, my court date was tuesday the 5th, which I ended up missing because of my car problem.
I ended up taking the bus to work and bumming rides home off of co-workers (bus doesn't run here late at night when I get off work).
My dad brought me a loaner car from my grandpa on thursday, and towed my car back home so he could look at it.
I drove back 150 miles Friday morning to go to court, my bench warrant was dismissed (yay), but the 4th degree misdemeanor still stands, I got a continuance so I can get a lawyer.
Aries girl finds my situation humorous, I kind of do too, but I take the charge very seriously.
So any DXPer's familiar with the law? Think I can get the charge dismissed based on extenuating circumstances? Or should I go for a plea and go to A.A. and get a suspended sentence?
Yes us Aries to tend to find the humour in life...for some reason, VPM you needed to experience this. Thank goodness you are FINE and were taken care of - you were not hurt and neither was anyone else, the rest can be delt with. 😉

You know, she'll probably never let you hear the end of this, every time she wants a chuckle. I know it's serious to you . . but, it IS funny, lol.
Disorderly Conduct (Public Intoxication), a 4th degree misdemeanor . . . is really nothing to be worried about. Probably 50% of the adult population has had some kind of stupid "thing" they did over booze. I had one myself, like 19 years ago . . and it's nothing. It doesn't effect anything, not your driver's license, not with your employer, and having it on record ONLY matters IF you have an additional charge relating to alcohol, or violence.
Don't worry about it (hehehe), it's nothing, just an embarassment and that's easily gotten over . . but, I'm not a lawyer, so what do I know?
Alright, you want help . . this is what I can offer you:
As you know, people WANT to hear what the WANT to hear, this goes for judges too.
Judges, cops, anybody in authority WANT to hear that you recognize and accept that you fucked up and that because you are a "grown-up", you are willing to take whatever consequences that may ensue. Using this tactic, I've gotten out of so many jambs, it isn't funny.
So, do this . . go to court and tell the Judge that you knew you drank too much and that you knew you couldn't drive (this will tell the judge you are adult and responsible enough NOT to drive intoxicated), that's why you called a cab. Tell the rest of the story as it happened . . just the admitting to the Judge that even though, you were intoxicated, you still had the concern of your drunkenness in mind.
When you tell him about being drunk and calling a cab, make sure you say something like, "I knew I couldn't drive like this. I wouldn't be able to live with myself if I had taken the chance and killed somebody." Play into that.
It's likely that the Judge will see this as just a mistake, and not trying to be disorderly, for he would see that IF you were disorderly, that would mean you were out of control and not caring about consequences . . but, for the fact that you still had a grip on your faculties enough NOT to drive, he'll see this for what it is . . a mistake.
Tell him what he WANTS to hear, vpmoon. Tell him that you know you screwed up by drinking too much, that's why you DIDN'T drive. Those words will be taken seriously, and your actions of NOT DRIVING will prove to him that you are honest.
It works, I've done it a million times. People don't want the truth, they want whatever satisfies their expectations.
I always get a good chuckle out of any stupid situations I get into hahah Just last night I got stuck in the mud after my friend had emphasized NOT to park there... well damn, it didn't look that bad! Had to stay the night. And the day before I intoxicated myself with that scotch guard stuff for shoes hahahaha It was so funny to me that I nearly died chuckling in the morning... apparently I couldn't afford to chuckle since I couldn't breathe and ended up having my mom rush me to the ER LOL I couldn't even move because my heart would start racing and aaugggghhwwwwwwwwwwwk my esophagus was closing in on me aaaaaaaaaugggghk lol

Well, the only reason I'm worried is that they're treating it as a 4th degree misdemeanor, not a minor misdemeanor... so that means I can get a max of 30 days in jail and/or a $ 250 fine.
But it's my first offense, so I don't think I will get jail time, I'm a virgo... and worrying is in my nature. 😛

(B) No person, while voluntarily intoxicated, shall do either of the following:
(1) In a public place or in the presence of two or more persons, engage in conduct likely to be offensive or to cause inconvenience, annoyance, or alarm to persons of ordinary sensibilities, which conduct the offender, if the offender were not intoxicated, should know is likely to have that effect on others;
(2) Engage in conduct or create a condition that presents a risk of physical harm to the offender or another, or to the property of another.
(C) Violation of any statute or ordinance of which an element is operating a motor vehicle, locomotive, watercraft, aircraft, or other vehicle while under the influence of alcohol or any drug of abuse, is not a violation of division (B) of this section.

(E) (1) Whoever violates this section is guilty of disorderly conduct.

(3) Disorderly conduct is a misdemeanor of the fourth degree if any of the following applies:
(a) The offender persists in disorderly conduct after reasonable warning or request to desist.
(b) The offense is committed in the vicinity of a school or in a school safety zone.
(c) The offense is committed in the presence of any law enforcement officer, firefighter, rescuer, medical person, emergency medical services person, or other authorized person who is engaged in the person's duties at the scene of a fire, accident, disaster, riot, or emergency of any kind.
(d) The offense is committed in the presence of any emergency facility person who is engaged in the person's duties in an emergency facility.
Everything in bold is what I am sure I am guilty of.
oh, I just re-read part 3... I don't think I am guilty of part (c)... but my Disordly Conduct was committed in the presence of law enforcement, I'm not so sure that me knocking on the wrong door would be considered an emergency.
