Thank you everyone! Yesterday was just shitty all the way around. First day back to work since I had my lumbar surgery several weeks back (Doctor doesn't even want me back until next week and PT work at best). So much has changed since I went out on medical i.e. they fired my wonderful boss and brought someone else in. But I digress, I am just bitching here.
I filed an emergency motion for custody of the kids last week. It was on the docket to be heard yesterday. It didn't go well and they judge wouldn't let me talk. What it boils down to: even though STBX is out the country and off the same Continent it doesn't matter. Even though I went through due diligence and mailed him the summons to his last known address with return receipt. Since he wasn't there and "properly" severed they couldn't give me temporary custody of the kids until our June court date. So when he comes back at the end of this month, there is nothing stopping him from take the children. Hell he could flee the country with them, which is my biggest fear. But Since I have done my due diligence in my attempts to locate him,they will allow me to publish his summons for the June court date in the newspaper. If he doesn't show up then I the judge will "probably" give me what I want.In the meantime, if he returns like he is suppose to at this end of this month, there is nothing I can do if he takes the kids. Possession is 9/10th of the law here. Only recourse I have is having him since the PSA as soon as he gets off the plan.

Logically, you wouldn't think he would. Before he left the country he was asking the kids who they wanted to live with because "that is what the judge would ask them" and if they wanted to move X Country, where he is now and his family is from. He has changed is mind about things so many times since I asked for the separation. I really don't know what he may do, I don't think he even knows. But I would rather be safe then sorry. Be proactive then reactive.

Thank you very much seraph. You humble me with your response. You are right, I always question, what could I have done better, what more could I have done. I took all the steps I could at this point and put in the last step yesterday. I need to have faith and allow the chips fall where they do while being proactive and doing what I must to protect the most precious things in my life.
