Sb, you are right in most aspect. What you're referring to are F1(student) or H1B(temporary job status) visas. H1B's must be sponsored by the employer and if it is known that the employer bypassed a top candidate because of not wishing to sponsor, pay the fees, etc, then that is discrimination. A company does NOT have the right to ask someone their citizenship or visa status during the application/interview process. It becomes OK to discuss this after an offer of employment is made.
